Acceptance of Terms By booking a tour with Tourly Tours, you confirm that you have read, understood, and agree to be bound by these terms.
2.1 Weather and Sea Conditions:
Our tours are subject to the whims of weather and sea conditions. In the event of unexpected or adverse weather conditions as reported by the Thai Meteorological Department, we may need to alter the tour itinerary for safety reasons. Should these changes prevent the tour from proceeding as scheduled, we will endeavor to reschedule. If rescheduling is not possible, you will be offered a full refund.
2.2 Changes Due to Site Closures:
Occasionally, certain areas or attractions may be closed due to maintenance, conservation efforts, or other administrative reasons beyond our control. Should such closures necessitate a change in the planned itinerary, we will seek to substitute the affected part of the tour with a comparable alternative that ensures a similarly enriching experience.
2.3 Traffic and Accessibility:
Tours may also be subject to change due to traffic conditions or accessibility issues. While we strive to stick to scheduled itineraries, sometimes unavoidable traffic or accessibility concerns may require itinerary adjustments. We will communicate any such changes as early as possible and work to minimize their impact on your tour experience.
2.4 General Provisions:
In all cases where a change is necessary, Tourly Tours prioritizes the safety and satisfaction of our clients. We appreciate your understanding and flexibility and assure you that any changes made will strive to enhance your travel experience. Refunds and rescheduling are handled on a case-by-case basis, reflecting our commitment to customer service and satisfaction.
3.1 General Cancellation Policy:
Customers can cancel their booking and receive a full refund if the cancellation is made more than 48 hours before the scheduled start of the tour. Cancellations must be made in writing via email or through our customer service portal. Some of our tours are non-refundable. Please review the specific terms associated with each tour prior to booking to understand whether a tour is non-refundable.
3.2 No-Shows:
No refunds will be provided for no-shows on the day of the tour. If you are unable to attend a tour, please notify us in advance as outlined in our cancellation policy.
3.3 Tour Cancellations by Tourly Tours:
In the rare event that Tourly Tours must cancel a tour due to unforeseen circumstances or inadequate participant numbers, we will notify customers as soon as possible. Affected customers will be offered an alternative tour date or a full refund, including for tours initially marked as non-refundable.
3.4 Processing Refunds:
All eligible refunds will be processed within 14 business days of the cancellation request. Refunds will be issued to the original method of payment unless otherwise specified by the customer.
4.1 Coverage Details:
Tourly Tours provides insurance coverage for all participants from the start of each tour. Our insurance policy covers up to 1,000,000 Baht per participant in the event of accidents or incidents that occur during the tour.
4.2 Eligibility for Coverage:
To be eligible for insurance coverage, participants must provide their full name and passport ID at the time of booking. This information is required for the insurance policy and must be accurately provided on the booking form.
4.3 Activation of Coverage:
Insurance coverage becomes active once the tour officially begins and remains in effect until the tour’s scheduled conclusion. Coverage is only applicable during the tour hours and does not extend beyond the completion of the tour.
4.4 What’s Covered:
Our insurance coverage includes, but is not limited to, medical expenses, accidental injury, and other liabilities directly related to the tour activities. Specific terms and limits of the coverage are detailed in the insurance policy documentation, which is available upon request.
4.5 Documentation for Claims:
Participants may be required to provide additional documentation or evidence (such as medical reports, police reports, etc.) for insurance claims. Failure to provide necessary documentation may affect or delay the processing of insurance claims.
4.6 Disclaimers and Limitations:
The insurance provided does not cover incidents that occur due to the participant's negligence, unlawful activities, or any actions that contravene the safety guidelines and instructions provided by Tourly Tours. Participants are advised to review the full insurance policy to understand the coverage scope and limitations.
5.1 Participant Responsibilities:
All tour participants are required to disclose any pre-existing medical conditions, allergies, or health concerns that may affect their ability to safely participate in the tour. It is essential that this information is provided at the time of booking to ensure that necessary precautions can be taken.
5.2 Fitness to Travel:
Participants must be in good physical health to undertake tours, especially those involving physical activities such as hiking, snorkeling, or cycling. Tourly Tours reserves the right to deny participation to any individual who does not meet the health and fitness requirements deemed necessary for a specific tour.
5.3 Safety Instructions:
Upon commencement of the tour, Tourly Tours will provide safety instructions related to the specific activities involved. Participants must adhere strictly to all safety instructions and guidelines provided by tour guides and operators. Failure to follow safety instructions may result in exclusion from the activity or tour.
5.4 Safety Equipment:
Where applicable, Tourly Tours will provide appropriate safety equipment. Participants are required to use all safety equipment as instructed. It is the responsibility of the participant to inform the tour guide or operator if the equipment does not fit properly or is uncomfortable.
5.5 Reporting Health Issues:
Participants must immediately report any health issues or concerns that arise during the tour to the tour guide or operator. This includes symptoms of illness or injury that may affect their well-being or the wellbeing of others on the tour.
6.1 General Behavior:
All participants are expected to conduct themselves in a respectful and courteous manner towards other members of the tour, tour staff, and local residents. Disruptive, disrespectful, or offensive behavior will not be tolerated.
6.2 Compliance with Local Laws and Customs:
Participants are required to comply with all local laws and respect local customs and traditions. Illegal activities, including drug use, theft, and vandalism, will result in immediate termination of tour services and may involve local authorities.
6.3 Interaction with Wildlife and Environment:
Tourly Tours is committed to environmental conservation and respectful wildlife interactions. Participants must follow all guidelines related to environmental preservation, including not littering, not disturbing wildlife, and adhering to specified paths and areas during tours.
6.3 Alcohol and Drugs:
Excessive consumption of alcohol is discouraged during our tours. The use of illegal drugs is strictly prohibited.
6.4 Safety Compliance:
For safety reasons, participants must follow all instructions given by the tour guides and operators during activities. Failure to comply with safety instructions or engaging in unsafe acts may result in exclusion from the activity or the entire tour.
6.5 Use of Photography and Media:
Participants are welcome to take photographs and videos for personal use, however, respect for fellow tourists' privacy is crucial. Unauthorised commercial use of images or videos captured during the tour is prohibited without prior consent from Tourly Tours and other relevant parties.
6.6 Dress Code:
Participants are advised to adhere to the dress code suitable for each activity and location, especially in religious or culturally sensitive areas. Instructions regarding appropriate attire will be provided as necessary.
Tourly Tours is committed to providing high-quality services. If you experience any dissatisfaction during your tour, please report it as soon as possible to our team. This allows us the opportunity to address and resolve the issue promptly.
Any claims for compensation or reimbursement beyond the initial complaint resolution must be submitted in writing by email: info@tourlytours.com no later than 14 days after the tour’s completion date. Such claims will be evaluated on a case-by-case basis in accordance with our terms and conditions.
Tourly Tours values your feedback as it helps us to improve our services. We strive to handle all complaints fairly and respectfully while ensuring a transparent and effective resolution process.
Miscellaneous
Governing Law:
These Terms and Conditions shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Thai courts.
Severability:
If any provision of these Terms and Conditions is determined to be invalid or unenforceable under any applicable law, such invalidity or unenforceability will not render these Terms and Conditions invalid as a whole, and such provisions will be deleted without affecting the remaining provisions herein.
Amendments:
Tourly Tours reserves the right to amend these Terms and Conditions at any time. All amendments to these Terms will be posted on our website and effective immediately upon posting. Your continued use of our services following any amendment signifies your acceptance of the revised Terms.
Assignment:
Tourly Tours may assign or transfer its rights and obligations under these Terms to any company, firm, or person at any time if it does not affect your rights under these Terms. You may not transfer your rights or obligations under these Terms to anyone else without our consent.
Force Majeure:
Tourly Tours will not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
Entire Agreement:
These Terms and Conditions constitute the entire agreement between you and Tourly Tours regarding your use of our services and supersede and replace any prior agreements we might have had between us regarding the services.
Waiver:
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Tourly Tours' failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
